How we collect, use, and protect your information.

This Privacy Policy explains how CMOBeatsRichie ("we", "us", "our") collects, uses, shares, and protects information when you visit our website, create an account, purchase a license, join our community, or otherwise use our services (the "Services"). By using the Services, you agree to this Policy.

1. Information We Collect

We collect the following categories of information:

a) Information you provide directly

  • Account info: name, username, email address, password (stored hashed), profile photo, bio, social links.
  • Artist application data: legal name, phone number, location, genres, streaming links, career details, and any other answers you submit through artist or membership forms.
  • Purchase info: billing name, billing email, shipping or billing address where applicable, and the products/licenses you purchase.
  • Communications: messages, support tickets, contact-form submissions, feedback, comments, and other content you post or send to us.
  • User content: uploaded songs, demos, audio links, playlists, and other content you choose to share.

b) Information collected automatically

  • Device & usage data: IP address, browser type and version, operating system, device identifiers, referrer URLs, pages viewed, links clicked, time on page, and timestamps.
  • Cookies and similar tech: see Section 4 below.
  • Diagnostic data: error logs and performance metrics to keep the Services running reliably.

c) Information from third parties

  • Payment processors: transaction status, last four digits of the card, brand, country, and risk/fraud signals. We never see or store your full card number.
  • Authentication providers: if you sign in with Google or another provider, we receive basic profile info (name, email, avatar) per your provider settings.
  • Email & analytics providers: delivery, open, and click events for emails we send you.

d) Sensitive data

We do not knowingly collect government IDs, biometric data, or other special-category personal data. Please do not submit such information through our Services.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Services (including delivering Beats, processing licenses, fulfilling memberships, and running community features).
  • Process payments, send receipts, and handle refunds, chargebacks, and tax requirements.
  • Authenticate users, prevent fraud and abuse, and enforce our Terms of Service.
  • Communicate with you about your account, purchases, support requests, and changes to the Services.
  • Send marketing emails, drops, and promotional content only with your consent, which you can withdraw at any time.
  • Personalize what you see — recommended beats, drops, and community content.
  • Comply with legal obligations and respond to lawful requests.

Legal bases (EEA/UK users): We process personal data on the basis of (i) performance of a contract (to provide the Services you request), (ii) legitimate interests (to keep the Services secure and improve them), (iii) consent (for marketing emails and certain cookies), and (iv) compliance with legal obligations.

3. Email Consent & Marketing

  • We send transactional emails (receipts, license delivery, account notices, support replies) because they are required to provide the Services you requested.
  • We send marketing emails (newsletters, drops, promotions) only when you opt in — for example, by checking a consent box at sign-up, requesting a free beat, or subscribing to the newsletter.
  • Every marketing email includes a one-click unsubscribe link. You can also update your email preferences in your account dashboard at any time.
  • Unsubscribing from marketing does not stop transactional emails tied to your purchases or account.

4. Cookies & Similar Technologies

We use cookies, local storage, and similar technologies to keep you signed in, remember your preferences, secure your session, measure usage, and (with your consent) deliver relevant marketing.

Categories we use:

  • Strictly necessary: authentication, security, cart and checkout. These cannot be disabled.
  • Functional: remember preferences such as audio player volume, theme, and recently played beats.
  • Analytics: aggregate usage data to help us improve the Services.
  • Marketing/Advertising (optional): used only with your consent where required by law.

You can control cookies through your browser settings and, where shown, through our cookie banner. Blocking strictly necessary cookies will break parts of the Services.

5. Payment Data Handling

  • Payments are processed by our PCI-DSS compliant payment processor (currently Stripe).
  • We do not see, store, or transmit your full card number, CVC, or bank login details. That data is sent directly from your browser to the payment processor over an encrypted connection.
  • We receive and store limited transaction details: order amount, currency, last four digits of the card, card brand, country, payment status, and the processor's transaction ID. We use these to deliver your purchase, send receipts, support refunds and disputes, prevent fraud, and meet accounting and tax obligations.
  • For tax compliance, our processor may calculate, collect, file, and remit applicable sales tax, VAT, or GST on our behalf.
  • See the processor's own privacy notice for how they handle your payment data.

6. How We Share Information

We do not sell your personal information. We share it only as follows:

  • Service providers acting on our behalf — payment processing, hosting, email delivery, analytics, customer support, and anti-fraud — under contracts that require them to protect your data.
  • Other users, where you choose to share — public profile, artist page, community posts, comments, and showcased releases. Do not post anything you do not want to be public.
  • Legal & safety — to comply with the law, respond to lawful requests, enforce our Terms, prevent fraud, or protect the rights, property, or safety of users and the public.
  • Business transfers — if CMOBeatsRichie is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership.

7. International Transfers

We operate online and may process and store information in countries other than your own, including the United States. Where required by law, we rely on appropriate safeguards (such as Standard Contractual Clauses) when transferring personal data internationally.

8. Data Retention

We keep personal information only as long as needed to provide the Services and for the purposes described in this Policy, including:

  • Account data: while your account is active and for a reasonable period afterward.
  • Transaction records: as required by tax, accounting, and anti-fraud laws (typically several years).
  • Marketing data: until you withdraw consent or unsubscribe.
  • Logs & analytics: for a limited period to detect abuse and improve performance.

When we no longer need your data, we delete or anonymize it.

9. Security

We use technical and organizational measures designed to protect your information — including encryption in transit (HTTPS), encrypted storage, role-based access controls, hashed passwords, and security monitoring. No system is 100% secure; please use a strong, unique password and notify us immediately of any suspected unauthorized access.

10. Your Rights

Depending on where you live, you may have the following rights regarding your personal data:

  • Access — request a copy of the personal information we hold about you.
  • Correction — ask us to fix inaccurate or incomplete data.
  • Deletion — ask us to delete your account and personal data, subject to legal retention obligations.
  • Portability — receive your data in a structured, machine-readable format.
  • Restriction & objection — restrict or object to certain processing, including direct marketing.
  • Withdraw consent — at any time, where processing is based on consent (e.g., marketing emails).
  • Lodge a complaint — with your local data protection authority.

California residents may have additional rights under the CCPA/CPRA, including the right to know what categories of personal information we collect, share, or "sell" (we do not sell personal information), and the right to non-discrimination for exercising these rights.

To exercise your rights, email support@cmobeatsrichie.com from the email address associated with your account, or use the privacy controls in your account dashboard. We may need to verify your identity before acting on a request.

11. Children's Privacy

The Services are not directed to children under 13 (or under 16 in the EEA/UK). We do not knowingly collect personal information from children. If you believe a child has provided us personal data, contact us and we will delete it.

12. Third-Party Links

The Services may link to third-party websites and platforms (e.g., Spotify, YouTube, Instagram). Their privacy practices are governed by their own policies; we are not responsible for them.

13. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you by email or in-app notice. Continued use of the Services after changes become effective constitutes acceptance.
